TERMS OF SERVICE
Effective Date: January 29, 2025
Welcome to Ken Kilday, LLC dba Leader’s Cut (“we,” “us,” or “our”). These Terms of Service (“TOS”) govern your use of our websites, services, and offerings, including Executive Coaching, Team Effectiveness Implementation, LinkedIn Consulting, Speaking Engagements, and other services provided by Leader’s Cut (collectively, the “Service”).
By accessing or using the Service, you agree to comply with these TOS. If you do not agree, please do not use the Service.
1. THE TERMS OF AWESOME
Most legal terms are loaded with jargon designed for CYA (Cover Your Ass) purposes. That’s not my style. Instead, here’s what you can expect from Leader’s Cut, and what I expect from you:
✅ You get a free Breakthrough Strategy Session. This is our chance to determine if we’re a good fit.
✅ You can add or change services as needed, within reason. Flexibility is a core value here.
✅ Billing is upfront. We work together on goals for a set term, not just a fixed number of sessions.
✅ You will be heard. If you have concerns or suggestions, I want to know.
✅ Confidentiality is a given. Your work with me is private unless you choose to share it publicly.
✅ Life happens. If something major (birth, death, illness) disrupts coaching, we can pause.
✅ You’re not just a number. I relate to each client with high expectations, deep compassion, and a focus on their genius.
2. ACCOUNT TERMS
🔹 Age Requirement: You must be 18 or older to use the Service.
🔹 Registration: You must provide accurate information when signing up, including your full legal name and valid email address.
🔹 Security: You are responsible for maintaining the confidentiality of your account and password.
🔹 Account Sharing: Each client account is for one person only—no sharing or transferring accounts.
🔹 No Bots: Registration by automated systems, bots, or scripts is prohibited.
🔹 Responsible Use: You must not engage in illegal or unauthorized activities, including copyright infringement, hacking, or spreading malware.
3. PAYMENT, REFUNDS, UPGRADES, AND CANCELLATIONS
🔹 Payment is due upfront for the agreed-upon term (monthly, quarterly, six-month, or annual).
🔹 Coaching fees are non-refundable. You’re paying for the expertise, structure, and accountability of coaching, not just the sessions.
🔹 No partial refunds for unused sessions or early terminations.
🔹 Payment Methods: We accept checks (paper/electronic), Venmo, PayPal, credit, and debit cards via secure invoicing.
4. MODIFICATIONS TO THE SERVICE & PRICING
🔹 We may update our services or pricing at any time, with 30 days’ notice via our website or email.
🔹 We may modify, suspend, or discontinue any part of the Service at any time.
5. CONFIDENTIALITY & DATA PRIVACY
🔹 Your information is confidential. I won’t disclose our work unless you publicly share it first.
🔹 Your data is handled securely. For details, see our Privacy Policy.
🔹 Third-Party Services: We use reputable third-party tools (e.g., payment processors, scheduling software). Their policies apply when using their platforms.
6. SERVICE EXPECTATIONS & SUPPORT
🔹 You’re responsible for engagement. Coaching works when you show up, do the work, and track your progress.
🔹 Appointments can be rescheduled. Need a different time? Just ask.
🔹 Tech support is provided only for paying clients via email or text.
🔹 We use third-party vendors for hosting, scheduling, and billing (e.g., Stripe, Calendly).
7. ACCEPTABLE USE POLICY
🔹 No spamming: Unsolicited emails, messages, or content are prohibited.
🔹 No hacking or tampering: Do not attempt to access restricted areas of our systems.
🔹 Respectful behavior required: Harassment, abuse, or threats toward Leader’s Cut employees or clients will result in immediate termination.
8. LIMITATION OF LIABILITY
By using our Service, you agree that:
🔹 We do not guarantee specific results. Coaching is a collaborative process, and results depend on your effort.
🔹 We are not responsible for business losses, revenue decline, or opportunity costs incurred due to coaching decisions.
🔹 The Service is provided “as is” and “as available” without warranties of any kind.
🔹 We are not liable for third-party platform failures (e.g., Zoom outages, Stripe payment issues).
9. TERMINATION & PAUSING ACCOUNTS
🔹 We reserve the right to terminate accounts for violations of these Terms.
🔹 Clients may request to pause their account due to serious life events.
10. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles.
11. CHANGES TO TERMS OF SERVICE
🔹 We may update these Terms at any time.
🔹 Changes will be posted on our website, and continued use of the Service constitutes acceptance.
